Using Vacation while on a Medical Leave Of Absence

A question was raised regarding the ability to use vacation, day at a time/week at a time, while on an approved Medical Leave of Absence. Currently there are Carriers who refuse to allow employees the opportunity to schedule vacation while on leave. They will only provide a lump sum payout of earned vacation.

The matter was escalated to our legal counsel and the answer (attached) is very clear; Any Carrier refusing scheduled single day/week at a time vacation to an employee on leave constitutes a violation of the National Vacation Agreement. The Council will promptly act when provided timely information for anyone affected.
